ஒரு முக்கியமான பொதுநல வழக்கு

நண்பர் சந்திரசேகரன் அவர்கள் அனுப்பிய மின்னஞ்சலை எனது இந்தப் பதிவின் விஷயமாக எடுத்து கொள்கிறேன். சந்திரசேகரனுக்கு என் நன்றி.
உச்ச நீதி மன்றம் சோஷலிசம் பற்றி கூறிய சில விஷயங்கள் இக்கட்டுரையில் உள்ளன. பின்னாளில் அந்த சுட்டி செயல்படாது போகக்கூடும் என்பதால் கட்டுரையை அப்படியே இங்கு நகலிட்டு ஒட்டுகிறேன்.

NEW DELHI: The Supreme Court on Tuesday refused to entertain a suggestion in a PIL which had sought deletion of the word "socialist" from the Constitution. The word "socialist" was added through the 42nd Amendment to the Constitution.

A bench comprising Chief Justice K G Balakrishnan, Justice R V Raveendran and Justice J M Panchal said, "Why do you (petitioner) take socialism in a narrow sense defined by (the) Communists. In broader sense, it means welfare measures for the citizens. It is a facet of democracy."

The court was hearing a PIL seeking direction to delete the word "socialist" from the Preamble to the Constitution on the ground that it was originally not there, and addition of the word amounted to re-writing of it.

"It hasn't got any definite meaning. It gets different meaning in different times," the bench observed.However, it agreed to hear the PIL which also sought to strike down the provision of the Representation of People Act (RPA) requiring a political party to adhere to socialism for being recognised.

The court will look into the issue of derecognising political parties which have wrongly shown allegiance to socialism in their manifesto despite their contrary objectives.The court, after hearing the contention of the petitioner, issued notices to the Centre and the Election Commission.

"It is contrary to the Constitution and to its democratic foundations that political parties be called upon to swear allegiance only to a particular mindset or ideology," said senior advocate Fali S Nariman, appearing for the petitioner, Kolkatta-based NGO Good Governance India Foundation.

Mr Nariman said, "Introducing the word 'socialist' in the Preamble breaches the basic structure and it is wholly inconsistent." "The attempt to deliberately tunnel the collective view in one ideological direction is also a grave breach of the liberty provisions of the Constitution," Mr Nariman said, seeking direction to strike down Sec 29A of the Representation of People Act".

இந்த் தருணத்தில் சோஷலிசம் என்ற வார்த்தையை அரசியல் நிர்ணயச் சட்டத்தின் முன்வாசகத்தில் 42-ஆம் சட்டத் திருத்தம் மூலம் இந்திரா திணித்த துரோக சிந்தனையை நினைவில் கொள்ள வேண்டும். விட்டிருந்தால் அந்த அன்னை மாதா தாயார் இந்தியாவை குட்டிச்சுவராக்கியிருப்பார். நல்ல வேளையாக 1977 தேர்தலை தான் வெற்றி பெறவோம் என்ற குருட்டு நம்பிக்கையில் நடத்தி, பிறகு மூலையில் உட்கார வைக்கப்பட்டாரோ நாடு பிழைத்ததோ. பிறகு 1979 இறுதியில் மீண்டும் பதவிக்கு வந்தாலும் அவரது பழைய விஷமச் செய்கைகள் நடத்த முடியாத அளவுக்கு மொரார்ஜி அவர்களது அரசு 44-ஆம் சட்டத் திருத்தத்தை நிறைவேற்றி காப்பாற்றியது. நாட்டை மேலே குட்டிச்சுவராக்க இந்திராவுக்கு சந்தர்பம் அமையாமல் போனது நாட்டின் அதிர்ஷ்டமே.

மீண்டும் இந்த சோஷலிசம் பற்றிய விஷயத்துக்கு வருகிறேன். அ.நி.ச. வை விவாதிக்கும் சமயத்திலேயே இது பற்றி பிரேரேபிக்கப்பட்டு அம்பேத்கர் அவர்களால் நல்ல காரணங்களால் நிராகரிக்கப்பட்டது. ஆனால் இப்போது நிலை என்னவென்றால் தேர்தலில் போட்டியிடும் எல்லா கட்சிகளுமே இந்த சோஷலிசம் என்னும் கோமாளித்தனமான கொள்கையை ஆதரிப்பதாகக் கூறவேண்டிய நிலை. என்ன செய்வது. ஒப்புக்காக செய்ய வேண்டியிருக்கிறது. அதைத் தவிர்க்க ஒரே வழி சோஷலிசம் என்ற வார்த்தையை நீக்குவதுதான்.

சோஷலிசம் என்றால் என்ன என்று ஒவ்வொருவரும் ஒவ்வொரு விதமாக கூறுகிறார்கள் என்று உச்ச நீதிமன்றமே கூறுகிறது. அப்படிப்பட்ட நிலையில் அதை ஒத்து கொள்கிறோம் என்று ஒரு கட்சி தேர்தலில் நிற்பதாகக் கூறுவதை எவ்வாறு சரிபார்க்க இயலும்? எடுத்த எடுப்பிலேயே கட்சிகளை பொய் சொல்லவைக்கும் இந்த ஷரத்து தேவைதானா?

1977-ல் சென்னை கடற்கரையில் ஒரு பெரிய கூட்டத்தில் பேசிய சோ அவர்கள் கூறினார். இந்தியா ஒரு ஜனநாயக, சோஷலிச பரம்பரை நாடு என்று கூட முடிந்தால் அன்னை மாதா தாயார் போட்டிருப்பார் என்று வேடிக்கையாகக் கூறினார்.

நான் கூறுவது இது ஒன்றுதான். வெட்ககரமான 42-ஆம் சட்டத் திருத்தத்துடன் சம்பந்தப்பட்டதாலேயே இந்த சோஷலிசம் என்ற வார்த்தை நீக்கப்பட வேண்டும் என்பதே. அது இந்த நாட்டின் அவமானச் சின்னம்.

சோஷலிசம் என்பது அண்ணாயிசம் என்பதைப்பொலவே தெளிவில்லாததுதான்! :-) ஆனால் ஒரு சந்தேகம், அரசியல் நிர்ணய சட்டத்தைத் திருத்தும்படி உத்தரவிட நீதிமன்றங்களுக்கு அதிகாரம் உண்டா? (காரணம் எதுவாக இருந்தாலும்).

அரசியல் நிர்ணயச் சட்டத்தில் செய்த திருத்தம் செல்லாது என்னும் தீர்ப்பு தர நன்றாகவே உரிமை உண்டு. அதுவும் அடிப்படை உரிமைகளை பாதுகாக்க உச்ச நீதி மன்றம் எப்போதுமே நடவடிக்கை எடுக்கும், எடுக்க வேண்டும். இல்லாவிட்டால் இந்திரா போன்ற சர்வாதிகாரிகள் நாடையே விற்றிருப்பார்கள்.

சோஷலிசம் என்பது அனைவரும் சமம் என்ற சட்டம் என்று நினைக்கிறேன், 'நினைக்கிறேன்' அவ்வளவு தான், என்னக்கு அரசியலிலும், அரசியல் சட்டத்திலும் அவ்வளவு அறிவு கிடையாது,
சோஷலிசம் நீக்க பட்டால் "இட ஒதுக்கிடு" கேட்டு மீண்டும் கோரிக்கை வைப்பார்கள்,
எனக்கு திறமை அடிபடையில் ஒதுக்கிடு இருக்க வேண்டும் என்று ஆசை,
இதற்கு சோஷலிசம் தடையாக இருக்குமா?

மக்களால் தேர்ந்தெடுக்கபடாத பிரகாஷ் கரத் நமது நாட்டின் கொள்கைகளை நிர்ணயிப்பது மிக அபத்தம். மேலும் பிரகாஷ் கரத் ராஜ்ஜிய சபையில் கூட இல்லாமல் இப்படி செய்வது வேக்ககேடு.

மத்ததுக்கெல்லாம் முனைவர் அம்பேத்கர் சொன்னார் என்று சொல்லும் இவர்கள், இதை ஒத்துக்க தயங்குவது ஏன்?

Dr. B. R. Ambedkar specifically explained the reason for the non-inclusion of the word "socialism", when it was sought to be inserted into the preamble by another member. He stated in the Assembly on 15th November, 1948:

"What should be the policy of the State, how the Society should be organized in its social and economic side are matters which must be decided by the people themselves according to time and circumstances. It cannot be laid down in the Constitution itself, because that is destroying democracy altogether. If you state in the Constitution that the social organization of the State shall take a particular form, you are, in my judgment, taking away the liberty of the people to decide what should be the social organization in which they wish to live. It is perfectly possible today, for the majority people to hold that the socialist organization of society is better than the capitalist organization of society. But it would be perfectly possible for thinking people to devise some other form of social organization which might be better than the socialist organization of today or of tomorrow. I do not see therefore why the Constitution should tie down the people to live in a particular form and not leave it to the people themselves to decide it for themselves."

இந்த சோஷியலிசத்திற்காக சத்தியப்பிரமாணம் எடுப்பதை பல நாளாக பலர் கேள்வி கேட்டு வந்துள்ளனர்.


இன்று இருக்கும் (இடது சாரி தவிற) அனைத்து கட்சிகளும் சோஷியலிசத்தை கடைபிடிப்பது கட்சி அரசியல் சடட்ப்படி Recognize ஆக வேண்டும் என்ற ஒரே காரணத்திற்காகத் தான். இப்படி எழுத்தளவில் கடைபிடித்து என்ன பிரயோசனம் ? ஏன் இந்த hypocrisy ?

சோசியலிசத்தை Representatives of people's act ல் இருந்து நீக்கிவிடலாம்.


"நாங்கள் கேபிடலிஸ்ட் கட்சி" என்று சொல்லிக் கொள்வது ஒரு கட்சியின் அடிப்படை உரிமை. அதை ஏந்தச் சட்டமும் தடுக்ககூடாது. 


Constitutional amendment பொருத்தவரை, அதை ஒரு ஜனநாயக அரசியல் கட்சி மெஜாரிட்டி ஆட்சியைப் பிடித்து அந்த இந்திராகாந்தி செய்த அட்டூளிய amendment ஐ null and void என அறிவித்தால் தீர்ந்தது.


பின்னர் "சோஷியலிசம் தான்" என்று சொபவர்கள் கோர்ட்டில் கேஸ் போட்டுக் கொண்டு நிற்பார்கள்.

நானும் அதை அறிவேன், ஏனெனில் அது பிளாக்கர் பின்னூட்டம் அல்ல. ஆனால் இப்போதுதான் கவனித்தேன், அது அதர் ஆப்ஷனில் போடப்பட்டுள்ளது என்பதை. அதற்காகவே அதை நீக்குகிறேன்.

உங்களது இப்பின்னூட்டமும் அதர் ஆப்ஷனில்தான் உள்ளது, ஆனால் இது பற்றி என்னுடன் தொலைபேசியுள்ளதால் சந்தேகம் ஏதுமில்லை.

அதாவது, ஏழைகள் எவ்வளவு உழைத்தாலும் முன்னேறி விடக்கூடாது. தாங்கள் போன்றவர்கள் மட்டுமே 'உழைத்து' (தமிழ் அல்லாத மற்ற மொழிகளில் மொழி பெயர்ப்பு செய்து காசு பார்ப்பது போன்று) முன்னேறவேண்டும் என்கிறீர்கள்?

உண்மையாக சோசியலிசம் ஒழிந்தால் உன்னைப் போன்ற ஏழைகள் ரத்தம் குடிக்கும் ரத்தக்காட்டேரிகள் ஒழிவார்கள் என்பது மட்டும் உன் கோபத்திலிருந்து தெரிகிறது.

BR Ambedkar அவர்கள் சொன்ன அந்த அருமையான விளக்கத்தை அனைவருக்கும் போய் சேரவேண்டி தமிழில் வெளியிடுமாறு தாழ்மையுடன் கேட்டுக்கொள்கிறேன்.

அன்பின் டோண்டு,

இடதுசாரிகளை மட்டுமே நீங்கள் குறை கூறுவது முறையாகாது. socialism என்ற பதத்தை congressஆர் மட்டுமின்றி பாரதீய ஜனதாவினரும் தங்களது கட்சிக் கொள்கையாகப் பிரகடனப் படுத்தியிருக்கிறார்கள் (1890ல் பாஜகவின் துவக்கவிழா மாநாட்டுரையில் பேசிய வாஜபேயி Gandhian socialism தான் அவரது கட்சியின் பொருளாதாரக் கொள்கையெனப் பிரகடனப்படுதினார்). தாராளமயமாக்கல் பற்றிப் பேசினால், CIA ஆள் என்ற முத்திரை குத்த பாஜகவும் தயங்கவில்லை. தெலுங்கு தேசம், அஹோம் கணபரிஷத் போன்ற பிராந்தியக் கட்சிகளூம்கூட பரவலாக சோஷியலிசத்தையே தங்கள் பொருளாதாரக் கொள்கையாக அறிவித்திருந்தது. காஞ்சி (பெரியவர்) சங்கராச்சாரியார்கூட ஹிந்துயிசத்தை ஒரு சோஷலிசக் கண்ணோட்டத்தில் காட்டும் முயற்சியில் இறங்கியதும் உண்டு. கர்நாடக சாளுவாளிகவும் சோஷலிஸ்ட்தான், லல்லு, முலாயம் எல்லாம் சோஷலிஸ்டுகள்தான் என்பதுதான் இந்தியா உணர்த்திய உண்மை!

நாம் எல்லாருமே சோவியத் யூனியன் கவிழும்வரை சும்மா இருந்துவிட்டு 'சோ' மாதிரி நான் அப்பவே சொன்னேனே என்று வெளிவரத்துவங்கினோம் (உண்மையில் சோ, அருண்ஷோரி போன்றவர்கள் ஒரு விரல் விட்டு சொல்லக்கூடிய exceptions, கம்யூனிசஸத்தை எதிர்கொள்ளவேண்டிய நிலையில் இருந்த சில RSSக்காரர்கள் 'சோஷலிச அபாயம்' குறித்து எச்சரிக்கை செய்தார்கள்தான்).

சாதி இந்துக்கள் (Caste Hindus, அதாவது mostly OBC மக்கள்) வசமிருந்த நிலங்கள் எப்படியாவது அவர்களிடமிருந்து பறிபோனால்தான், தங்களுக்கு நல்லது என்று நினைத்த பார்ப்பன சமூகமே சோஷலிசத்தை உயர்த்திப்பிடித்தது; அதேபோல, நாட்டில் அன்று இருந்த மிகப் பெரிய (டாட்டா, பிர்லா போல) தொழிலதிபர்கள் எல்லாம் பார்ப்பனரல்லாதவர்கள் அல்லவா, அதனாலேயே, பெரும்பாலும் ஏழைகளாகவும், மத்தியத்தர வெள்ளைக்காலர்களாகவுமே இருந்த பார்ப்பன சமூகத்தினர் 'சோஷலிச கோஷம்' போட்டனர்; நீங்களே யூகித்துவிடலாம், எத்தனை கடைகள் பார்பனருக்குச் சொந்தமாக இருந்தது என்று. அதனாலேயே 'பந்த்' 'ஹர்தால்' 'கடையடைப்பு' என்று எதுவந்தாலுமே பார்பனர் நலன் பாதிப்புக்குள்ளாகாது அல்லவா? அவஸ்தைப் படப்போவது எல்லாம் வணிகர்கள்தானே, அப்பாவி மார்வாடி, பனியாக்களும், செட்டியார்-ரெட்டியார்-முதலியார் வகையினர்தானே - அதனால், 'அடிக்கடி பந்த்' 'திடீர் பந்த்' நிகழ்த்தும் கம்யூனிஸ்டுகள் மேல் பார்ப்பனர்களுக்குக் கோபம் வராதது ஆச்சரியமில்லைதான். அதனாலேயே, இன்றுவரை, பார்ப்பனர் தயவில்தானே socialism/communismகளின் அனைத்து shadeகளிலும் உள்ள கட்சிகள் அமைப்புகள் வாழ்ந்து கொண்டிருக்கிறது (கேரளம்/மேற்கு வங்கம்). நந்திகிராமில் அதைத்தானே பார்த்தோம்.

கம்யூனிஸ்டுகளை சகலத்திலும் ஆதரித்த பார்ப்பனர்கள், கோயில்களில் பொதுவுடைமை (அனைத்து சாதியினரும் அர்ச்சகராக்கும் விடயத்தில்) கடைபிடிப்பதில் மட்டும் தயங்குகிறார்களே, அது ஏன்? கடவுளே இல்லை, கோயில் தேவையில்லை என்ற கொள்கையையே பார்ப்பனர்கள் தங்களுக்கு வசதியாகப் பயன்படுத்திக்கொண்டனர் எனலாம் - பிறசாதியினரும் ஆன்மிக அறிவையும் பெற்றுவிடக்கூடாதே, சம்ஸ்கிருதத்தைப் படித்துவிடக் கூடாதே, அர்ச்சகராகிவிடக்கூதாதே - அதுதானே பார்ப்பன அரசியல் திட்டம். 'கடவுள் இல்லை' என்ற கொள்கைதானே பார்ப்பனரல்லாதோரை ஆன்மிகம்/கோயில்/ஹிந்துயிசம் பக்கம் போகாமல் தடுக்க சித்தாந்தரீதியாகச் செய்யும்?

சோஷலிசம் = பார்ப்பனீயம்

ஹிட்லர்கூட தனது கட்சிக்கு National Socialist Party என்றுதானே வைத்தார்?!

குஜராத் முதல்வர் நரேந்திர மோடி தமிழக விஜயம் தான் அது. காங்கிரஸ் கட்சிக்குச் சொந்தமான காமராஜர் அரங்கத்தில் மீட்டிங். அதைத் தடுக்க சில துலுக்க அடிப்படைவாத இயக்கங்கள் முயற்ச்சி செய்கின்றன.


அதில் usual suspects அதி தீவிர மனித விரோத திராவிட நாய்களும், இன்ன பிற மாவோயிச, கம்யூனிச ஒட்டுண்ணிகளும் கலந்து கொண்டுள்ளனர்.


இந்த 2008 போகியன்று, பழயன (கம்யூனிசம், சோஷியலிசம், துலுக்கனுக்கு தூக்குபிடிக்கும் செக்குலரிசம் ) எல்லாம் கொழுத்தப்படவேண்டும். அதற்கான காலம் நெருங்கிவிட்டது என்று நம்புகிறேன்.

Socialism for the rich

Although socialism has long claimed to be for the poor, it has probably done more damage, on net balance, to the poor than to the rich. After all, the rich have enough money to leave the country if they think the socialists are going to do them any serious harm.

Some of our own rich have already had their money leave the country, to be sheltered from the higher taxes that limousine liberals say we should all pay. Meanwhile, the liberal media give them kudos for their selfless advocacy of higher taxes on higher income people, forgetting that these are not taxes on wealth.

Most of the people in the upper income brackets are not rich and do not have wealth sheltered offshore. They are typically working people who have finally reached their peak earning years after many years of far more modest incomes -- and now see much of what they have worked for siphoned off by politicians, to the accompaniment of lofty rhetoric.

The rich have learned to adapt socialist policies to their own benefit. For example, the city of Riviera Beach, Florida, is planning to demolish a working class neighborhood under its power of eminent domain, in order to prepare the way for a marina for yachts, luxury condominiums and an upscale shopping district.

What will the city of Riviera Beach get out of all this? More taxes from higher-income people, enabling local politicians to spend more money on programs to attract votes.

Meanwhile the rich get rid of lower-income folks without having to pay them the value of their homes and businesses that will be demolished. As in so many other cases, eminent domain is socialism for the rich.

Theoretically, those whose homes and businesses are demolished will get the "just compensation" to which the Constitution says they are entitled.

In reality, just announcing plans to demolish the homes in an area will immediately demolish part of their market value. Even if homeowners are compensated for whatever value remains when their homes are actually demolished -- which can be years later -- they have still been had.

For businesses, compensating them for the value of their physical assets -- which may or may not include ownership of the place where their businesses are located -- does nothing to compensate them for the often much larger value of the clientele they have built up over the years but who are now scattered to the winds by neighborhood demolition.

This game doesn't work the same way in rich neighborhoods. Not only can the rich hire big-bucks lawyers to fight city hall, why would city hall want to get rid of upscale taxpayers, who are often also big donors to political campaigns?

A very different form of socialism for the rich protects their communities from even the dangers of a free market. A whole array of laws and policies prevents outsiders from buying up property near them, even when these outsiders are ready to pay prices determined by supply and demand, rather than by eminent domain.

For example, the "open space" laws that have spread across the country to protect upscale communities represent one of the biggest collectivizations of land since the days of Josef Stalin.

Upscale residents say that they have a right to protect "our community." But not even the rich own the whole community.

They own what they paid for -- their own individual property. But they get the government to collectivize the often vastly larger surrounding property, in order to keep the unwashed masses from settling near them and spoiling their views.

Moreover, they wrap themselves in the mantle of idealism while doing this and denounce the "selfishness" of those who would stoop to building homes or apartments to house others, just to make money.

"Developer" is a cuss word to those who wax indignant in their righteous zeal to keep other people out. Why can't these money-grubbing developers just inherit money, like so many of the upscale idealists?

Meanwhile, back in the working class neighborhood in Riviera Beach, it is being defended legally by the Institute for Justice, one of the few "public interest" organizations that deserve the name.

HOW MANY DID COMMUNIST REGIMES MURDER?

With the passing of communism into history as an ideological alternative to democracy it is time to do some accounting of its human costs.
Few would deny any longer that communism--Marxism-Leninism and its variants--meant in practice bloody terrorism, deadly purges, lethal gulags and forced labor, fatal deportations, man-made famines, extrajudicial executions and show trials, and genocide. It is also widely known that as a result millions of innocent people have been murdered in cold blood. Yet there has been virtually no concentrated statistical work on what this total might be.
For about eight years I have been sifting through thousands of sources trying to determine the extent of democide (genocide and mass murder) in this century. As a result of that effort** I am able to give some conservative figures on what is an unrivaled communist hecatomb, and to compare this to overall world totals.
First, however, I should clarify the term democide. It means for governments what murder means for an individual under municipal law. It is the premeditated killing of a person in cold blood, or causing the death of a person through reckless and wanton disregard for their life. Thus, a government incarcerating people in a prison under such deadly conditions that they die in a few years is murder by the state--democide--as would parents letting a child die from malnutrition and exposure be murder. So would government forced labor that kills a person within months or a couple of years be murder. So would government created famines that then are ignored or knowingly aggravated by government action be murder of those who starve to death. And obviously, extrajudicial executions, death by torture, government massacres, and all genocidal killing be murder. However, judicial executions for crimes that internationally would be considered capital offenses, such as for murder or treason (as long as it is clear that these are not fabricated for the purpose of executing the accused, as in communist show trials), are not democide. Nor is democide the killing of enemy soldiers in combat or of armed rebels, nor of noncombatants as a result of military action against military targets.
With this understanding of democide, Table 1 lists all communist governments that have committed any form of democide and gives their estimated total domestic and foreign democide and its annual rate (the percent of a government's domestic population murdered per year). It also shows the total for communist guerrillas (including quasi-governments, as of the Mao soviets in China prior to the communist victory in 1949) and the world total for all governments and guerillas (including such quasi-governments as of the White Armies during the Russian civil war in 1917-1922). Figure 1 graphs the communist megamurderers and compares this to the communist and world totals.
Of course, eventhough systematically determined and calculated, all these figures and their graph are only rough approximations. Even were we to have total access to all communist archives we still would not be able to calculate precisely how many the communists murdered. Consider that even in spite of the archival statistics and detailed reports of survivors, the best experts still disagree by over 40 percent on the total number of Jews killed by the Nazis. We cannot expect near this accuracy for the victims of communism. We can, however, get a probable order of magnitude and a relative approximation of these deaths within a most likely range. And that is what the figures in Table 1 are meant to be. Their apparent precision is only due to the total for most communist governments being the summation of dozens of subtotals (as of forced labor deaths each year) and calculations (as in extrapolating scholarly estimates of executions or massacres).
With this understood, the Soviet Union appears the greatest megamurderer of all, apparently killing near 61,000,000 people. Stalin himself is responsible for almost 43,000,000 of these. Most of the deaths, perhaps around 39,000,000 are due to lethal forced labor in gulag and transit thereto. Communist China up to 1987, but mainly from 1949 through the cultural revolution, which alone may have seen over 1,000,000 murdered, is the second worst megamurderer. Then there are the lesser megamurderers, such as North Korea and Tito's Yugoslavia.
Obviously the population that is available to kill will make a big difference in the total democide, and thus the annual percentage rate of democide is revealing. By far, the most deadly of all communist countries and, indeed, in this century by far, has been Cambodia under the Khmer Rouge. Pol Pot and his crew likely killed some 2,000,000 Cambodians from April 1975 through December 1978 out of a population of around 7,000,000. This is an annual rate of over 8 percent of the population murdered, or odds of an average Cambodian surviving Pol Pot's rule of slightly over just over 2 to 1.
In sum the communist probably have murdered something like 110,000,000, or near two-thirds of all those killed by all governments, quasi-governments, and guerrillas from 1900 to 1987. Of course, the world total itself it shocking. It is several times the 38,000,000 battle-dead that have been killed in all this century's international and domestic wars. Yet the probable number of murders by the Soviet Union alone--one communist country-- well surpasses this cost of war. And those murders of communist China almost equal it.
Figure 2 shows the major sources of death for those murdered under communism and compares this to world totals for each source for this century. A few of these sources require some clarification. Deaths through government terrorism means the killing of specific individuals by assassination, extrajudicial executions, torture, beatings, and such. Massacre, on the other hand, means the indiscriminate mass killing of people, as in soldiers machine gunning demonstrators, or entering a village and killing all of its inhabitants. As used here, genocide is the killing of people because of their ethnicity, race, religion, or language. And democide through deportation is the killing of people during their forced mass transportation to distant regions and their death as a direct result, such as through starvation or exposure. Democidal famine is that which is purposely caused or aggravated by government or which is knowingly ignored and aid to its victims is withheld.
As can be seen in the figure, communist forced labor was particularly deadly. It not only accounts for most deaths under communism, but is close to the world total, which also includes colonial forced labor deaths (as in German, Portuguese, and Spanish colonies). Communists also committed genocide, to be sure, but only near half of the world total. Communists are much less disposed to massacre then were many other noncommunist governments (such as the Japanese military during World War II, or the Nationalist Chinese government from 1928 to 1949). As can be seen from the comparative total for terrorism, communists were much more discriminating in their killing overall, even to the extent in the Soviet Union, communist China, and Vietnam, at least, of using a quota system. Top officials would order local officials to kill a certain number of "enemies of the people," "rightists", or "tyrants".
How can we understand all this killing by communists? It is the marriage of an absolutist ideology with the absolute power. Communists believed that they knew the truth, absolutely. They believed that they knew through Marxism what would bring about the greatest human welfare and happiness. And they believed that power, the dictatorship of the proletariat, must be used to tear down the old feudal or capitalist order and rebuild society and culture to realize this utopia. Nothing must stand in the way of its achievement. Government--the Communist Party--was thus above any law. All institutions, cultural norms, traditions, and sentiments were expendable. And the people were as though lumber and bricks, to be used in building the new world.
Constructing this utopia was seen as though a war on poverty, exploitation, imperialism, and inequality. And for the greater good, as in a real war, people are killed. And thus this war for the communist utopia had its necessary enemy casualties, the clergy, bourgeoisie, capitalists, wreckers, counterrevolutionaries, rightists, tyrants, rich, landlords, and noncombatants that unfortunately got caught in the battle. In a war millions may die, but the cause may be well justified, as in the defeat of Hitler and an utterly racist Nazism. And to many communists, the cause of a communist utopia was such as to justify all the deaths. The irony of this is that communism in practice, even after decades of total control, did not improve the lot of the average person, but usually made their living conditions worse than before the revolution. It is not by chance that the greatest famines have occurred within the Soviet Union (about 5,000,000 dead during 1921-23 and 7,000,000 from 1932-3) and communist China (about 27,000,000 dead from 1959-61). In total almost 55,000,000 people died in various communist famines and associated diseases, a little over 10,000,000 of them from democidal famine. This is as though the total population of Turkey, Iran, or Thailand had been completely wiped out. And that something like 35,000,000 people fled communist countries as refugees, as though the countries of Argentina or Columbia had been totally emptied of all their people, was an unparalleled vote against the utopian pretensions of Marxism-Leninism.
But communists could not be wrong. After all, their knowledge was scientific, based on historical materialism, an understanding of the dialectical process in nature and human society, and a materialist (and thus realistic) view of nature. Marx has shown empirically where society has been and why, and he and his interpreters proved that it was destined for a communist end. No one could prevent this, but only stand in the way and delay it at the cost of more human misery. Those who disagreed with this world view and even with some of the proper interpretations of Marx and Lenin were, without a scintilla of doubt, wrong. After all, did not Marx or Lenin or Stalin or Mao say that. . . . In other words, communism was like a fanatical religion. It had its revealed text and chief interpreters. It had its priests and their ritualistic prose with all the answers. It had a heaven, and the proper behavior to reach it. It had its appeal to faith. And it had its crusade against nonbelievers.
What made this secular religion so utterly lethal was its seizure of all the state's instrument of force and coercion and their immediate use to destroy or control all independent sources of power, such as the church, the professions, private businesses, schools, and, of course, the family. The result is what we see in Table 1.
But communism does not stand alone in such mass murder. We do have the example of Nazi Germany, which may have itself murdered some 20,000,000 Jews, Poles, Ukrainians, Russians, Yugoslaves, Frenchmen, and other nationalities. Then there is the Nationalist government of China under Chiang Kai-shek, which murdered near 10,000,000 Chinese from 1928 to 1949, and the Japanese militarists who murdered almost 6,000,000 Chinese, Indonesians, Indochinese, Koreans, Filipinos, and others during world War II. And then we have the 1,000,000 or more Bengalis and Hindus killed in East Pakistan (now Bangladesh) in 1971 by the Pakistan military. Nor should we forget the mass expulsion of ethnic Germans and German citizens from Eastern Europe at the end of World War II, particularly by the Polish government as it seized the German Eastern Territories, killing perhaps over 1,000,000 of them. Nor should we ignore the 1,000,000 plus deaths in Mexico from 1900 to 1920, many of these poor Indians and peasants being killed by forced labor on barbaric haciendas. And one could go on and on to detail various kinds of noncommunist democide.
But what connects them all is this. As a government's power is more unrestrained, as its power reaches into all the corners of culture and society, and as it is less democratic, then the more likely it is to kill its own citizens. There is more than a correlation here. As totalitarian power increases, democide multiplies until it curves sharply upward when totalitarianism is near absolute. As a governing elite has the power to do whatever it wants, whether to satisfy its most personal desires, to pursue what it believes is right and true, it may do so whatever the cost in lives. In this case power is the necessary condition for mass murder. Once an elite have it, other causes and conditions can operated to bring about the immediate genocide, terrorism, massacres, or whatever killing an elite feels is warranted.
Finally, at the extreme of totalitarian power we have the greatest extreme of democide. Communist governments have almost without exception wielded the most absolute power and their greatest killing (such as during Stalin's reign or the height of Mao's power) has taken place when they have been in their own history most totalitarian. As most communist governments underwent increasing liberalization and a loosening of centralized power in the 1960s through the 1980s, the pace of killing dropped off sharply.
Communism has been the greatest social engineering experiment we have ever seen. It failed utterly and in doing so it killed over 100,000,000 men, women, and children, not to mention the near 30,000,000 of its subjects that died in its often aggressive wars and the rebellions it provoked. But there is a larger lesson to be learned from this horrendous sacrifice to one ideology. That is that no one can be trusted with power. The more power the center has to impose the beliefs of an ideological or religious elite or impose the whims of a dictator, the more likely human lives are to be sacrificed. This is but one reason, but perhaps the most important one, for fostering liberal democracy.

Socialist supermen murdered millions in a single bound!

George Bernard Shaw shares blame for turning the swastika into alphabetical symbolism of S-letters for "socialism." Although an ancient symbol, the swastika was altered into a utopian emblem of "super socialist society" for the new "socialist supermen."

Shaw's missteps were followed by the National Socialist German Workers'Party and by other socialists.

Shaw authored "Man and Superman," a 1903 play. Although Man and Superman can be performed as a light comedy of manners, Shaw intended it to be something much deeper than that, as can be seen by the play's very title. Socialists present every socialist leader as a Superman (Ãœbermensch or Overman). German National Socialists presented their leader as the Ãœbermensch.

Shaw's plot is centered on John Tanner, author of "The Revolutionist's Handbook and Pocket Companion."

Shaw had a vision (letter to Henry James of 17 January 1909): "I, as a Socialist, have had to preach, as much as anyone, the enormous power of the environment. We can change it; we must change it; there is absolutely no other sense in life than the task of changing it. What is the use of writing plays, what is the use of writing anything, if there is not a will which finally moulds chaos itself into a race of gods."

The "race of Gods" idea molded German socialism and its use of the swastika as its alphabetical symbolism. The swastika's "Aryan" etymology to German Socialists included the dictionary's second meaning: "noble" or "high rank." They used it to mean a "master race" or "noble class" or "ruling class." That ties into the swastika as a "superman" emblem for the cockamamy "super socialist man."

In comic-book fashion, German socialists plastered their symbol on everything, including uniforms and clothing, as if their dogma was a big "S" on the chest of superman's suit in a cartoon.

Everyone concedes that the swastika was the symbol of the National Socialist German Workers' Party (NSGWP). In that sense, the swastika was a symbol of socialism, at least for the NSGWP. The next question is the question that everyone else overlooked: Did the NSGWP (or its leader), in using the swastika symbol for the National Socialist German Workers' Party, ever view the swastika as actual S-letters (for their "socialism")? It did, according to discoveries by the historian Dr. Rex Curry (author of "Swastika Secrets").

There are other examples of similar S-style swastika symbolism used by German socialists, including the SS Division, and in Adolf Hitler's own bizarre signature. Similar alphabetic symbolism is visible every day in Volkswagen VW logos. Dr. Curry's work changed the way that the public thinks about the swastika symbol (and about the VW symbol).

That utopian totalitarianism (of Shaw and German socialists) mirrored that of earlier American socialists, and other totalitarian socialist societies. It was the same dogma that led to the socialist Wholecaust (of which the Holocaust was a part): 60 million slaughtered under the former Union of Soviet Socialist Republics; 50 million under the Peoples' Republic of China; 20 million under the National Socialist German Workers' Party. Socialists turned out to be superkillers, able to murder millions in a single bound. American socialists used the swastika as their utopian symbol as early as 1875, when the Theosophical Society was founded in New York. The Theosophical Society teamed up with the Nationalism movement started by the American Socialist Edward Bellamy, famous author of the international bestseller "Looking Backward" (1887). Edward Bellamy was cousin and cohort to Francis Bellamy, another famous American socialist who created the Pledge Of Allegiance, the origin of the stiff-arm salute adopted later by German socialists. Next, the Soviet socialist swastika appeared as a symbol of socialism. It also pre-dated the swastika of German Socialists. Later, the hammer and sickle became the Soviet swastika. http://rexcurry.net/ussr-socialist-swastika-cccp-sssr.html

Having visited the USSR in 1930s, Shaw became an ardent supporter of Stalin and Soviet Socialism. After being duped by a carefully managed tour of the country, Shaw declared all the stories of the socialist Wholecaust were slander. Stalin's super name meant "Steel" as in "Man of Steel" ("Man of Steal" is a better translation. Ruling with a steel fist and a steel heart, Stalin steals everything). In private, Stalin disparaged Shaw. Americans noted that Shaw did not want to stay permanently in the "paradise" of Super Soviet Society with its new Soviet socialist man.

Nine years after Shaw's visit, the Union of Soviet Socialist Republics joined as allies with the National Socialist German Workers' Party to invade Poland in a pact (Molotov-Ribbentrop) to divide up Europe.

Shaw and the Bellamys went on to promote socialism in the USA, and their dogma explains the enormous size and scope of government today, the growing police-state, and aggressive military socialism. Republican-socialists are outspending Democrat-socialists by more than double and growing (in social spending alone).

Wikipedia is helping to announce the new discoveries. Opinion Editorials reported on the many references to Dr. Curry's research on Wikipedia. It might be the most referenced historical work on Wikipedia. Even Jimmy Wales, Wikipedia's founder, has publicly noted the historian's influence on Wikipedia. Wikipedia writers have reviewed and verified the research. Some Wikipedia writers use it without attribution in apparent attempts to bolster their own credibility.

Of course, Wikipedia is actually an anonymous bulletin where information can change by the minute and where lies are posted deliberately, and truths are deleted deliberately.

The accuracy of Wikipedia's Roman salute article has fluctuated widely. In the past, the article contained numerous absurdities and even claimed that the stiff-arm salute was an ancient Roman salute and was the origin of the USA's Pledge gesture (until Dr. Curry's work disproved that claim). Afterward, Wikpedia's Roman salute article improved. The article then went downhill fast as other wikilings deleted facts and concocted a new lie using a neo-classical painter. Wikipedia has experienced many short bursts of accuracy (such as when new discoveries by Dr. Curry are publicized), but accurate periods are often short at Wikipedia. Here is another example. A recent web search for "British Union of Fascists and National Socialists" (hereafter BUFNS) showed Dr. Curry's work on top, and showed no article at all on Wikipedia. Wikipedia leaves the public with the misimpression that the BUFNS never existed, or that its name-change never occurred. It is more revisionist history airbrushed away at Wakipedia. That glaring omission at Wikipedia has gained a lot of media attention for a long time, and yet the omission was still there in a recent web search. It joins many well-known running jokes about Wikipedia. It also suggests that writers on Wikipedia are few or inattentive, or that their omissions are maintained deliberately, while corrections are blocked or deleted. Many errors on Wikipedia are created deliberately for purposes of political propaganda.

Those errors and others are turning Wakipedia into a laughingstock.

Amazon.com adopted as its policies some recommendations advocated by Dr. Curry to fight neo-Nazi vandalism. As reported in Opinion Editorials, Amazon's web site deletes and discourages use of the common 4-letter shorthand n-word for "National Socialist German Workers' Party" within Amazon's reviews, product information, tags and other uses. By fighting the shorthand term, Amazon encourages customers to learn and to use the actual accurate name of the monstrous group: National Socialist German Workers' Party.

Widespread ignorance exists in the media and in the general public about what the 4-letter abbreviation abbreviates. That etymological ignorance has grown through overuse of the hackneyed shorthand term in print and in government schools (socialist schools). Amazon is helping to reverse the ignorant habit within the media and the public.

A History of US: Book 9: War, Peace, and All That Jazz 1918-1945 (History of Us)

I doubt there's any US History textbooks more excitingly written for kids age 9-12 than Joy Hakim's. (This series is the one used in one of the best private schools in Silicon Valley.) They're glossy and beautiful, and well-nigh irresistible. What an incredible shame. What's the problem? The problem is they contain a version of history so slanted as to amount to an utterly shameless propagandizing of children. I'm a liberal atheist, but, really, these books should be sealed into a time capsule, to entertain future historians.
I assume Hakim simply doesn't know any better, but even a Marxist with a PhD in American History would blush a little to discover that a child reading this series would never suspect that close to 100 million innocent men, women, and children died under the yoke of socialist regimes, nor that a third of the world was plunged into an unnecessary grinding poverty for decades. On the other hand, they will learn, as they should, that National Socialism murdered six million innocents, and that the Ku Klux Klan `grew hugely' in the 1920s. But they won't learn that any other serious totalitarian movements also grew hugely in the 1920s, or that five million innocents died under the rule of Lenin's first experiment in socialism in the 1920s.

On the contrary, all anti-Communism in the twentieth century is presented as nothing better than a witch-hunt. Indeed, anti-communism is literally referred to as a `witch-hunt,' several times. Come on. So, was the fight against Hitler's National Socialism a `witch-hunt'? Why such a palpable double standard for twin evils? Hakim teaches children that while National Socialism was indeed a real and present danger, and even worth waging an unprecedented World War to fight it, on the other hand, international socialism, or Communism, was, as she tells it, never any real danger to Americans.

For instance, there's a chapter on the HUAC hearings in which McCarthy is referred to as a 'liar' about a half a dozen times. The chapter literally begins with the opening sentence "Joe McCarthy was a liar." Sure, he's controversial, but the latest research by historians just doesn't back up Hakim's wild-eyed account of liberal anti-socialism in America as nothing better than a nefarious `witch-hunt' conducted by `liars' and oppressors. Totalitarian Communist Lillian Hellman is profiled as a hero, and the overall impression is given that none of these people really were Communists, but, instead, were all just as falsely accused as the supposed `witches' of Salem.

This conclusion is then used to prove the statement that Americans are a fundamentally paranoid people, who basically lose their marbles very once in a while. (See book "Not Without Honor." on McCarthy and PBS documentary on Salem to find out why even Salem wasn't actually paranoia after all, but a toxic crop of moldy rye.)

TODAY'S EDITORIAL: We're All Socialists

Many of us are probably aware that the preamble to the Indian Constitution says that India is a socialist - along with being a secular and democratic - republic. But have we ever thought about how seriously to take the socialist tag? A PIL filed in the Supreme Court by an NGO wants to test exactly that. The PIL challenges the insertion of the word 'socialist' in the preamble through the 42nd amendment in 1976 during the Emergency. The PIL is also challenging an amendment to the Representation of the People Act (RPA) in 1989 where it was made mandatory for political parties to swear allegiance to socialism during registration.

This is not the first challenge to the compulsory allegiance to socialism by political parties. An earlier petition by the Swatantra Party challenging the amendment to RPA has been before the Bombay high court for over a decade. What the courts now have to decide is whether forced loyalty to socialism is legitimate. One of the reasons cited by those who have filed the PIL is that the amendment violates the right to freedom of speech and expression as well as the right to form associations or unions present in the Indian Constitution.

This argument has several things going for it. In a democracy, no citizen or party should be forced to subscribe to any ideology. The presence of the word 'socialist' in the preamble could be taken to mean a broad guiding policy with which all Indian citizens need not agree. However, making it mandatory for all registered parties to pledge loyalty to socialism cuts into Article 19(c), which gives the right to form associations or unions.

Indeed, it is anti-democratic to expect all parties to owe allegiance to socialism. We also need to recall that the word ‘socialism’ was inserted in the Constitution through an amendment that authorised authoritarian measures under the guise of social revolution.

In its first hearing of the case, a three-judge bench of the Supreme Court has observed that socialism is a facet of demo-cracy. That is arguable. But even if that were so, why shouldn’t a party which believes in the free market or capitalism be allowed to register? This case is not just about legal hair-splitting. Far from it.

It exposes an inherent hypocrisy in our political system where in spite of an embrace of the free market, we still feel a need to bow before the altar of socialism. It’s time we shed these double standards. One way to do so would be to take a hard look at the need to have constitutionally mandated socialism.

India's Socialist Constitution

India is a democracy, but according to the Supreme Court it's less democratic than you might think. The justices recently shot down a challenge to Indira Gandhi's 1970s-era ploy to stamp her economic policies on the country in perpetuity. At issue: Does the word "socialism" belong in the Indian Constitution? And is every political party required to be socialist even if such a requirement is antithetical to free speech?

The Good Governance India Foundation, a small think tank, had petitioned to remove "socialism" from the Constitution's preamble. The text currently opens with: "We, the people of India, having solemnly resolved to constitute India into a Sovereign Socialist Secular Democratic Republic. . . ." The foundation argued that this wording conflicts with the original intent and the "basic structure" of the Constitution. The court disagreed, choosing to believe that "socialism" has many meanings and its inclusion in the preamble is not antithetical to open debate.

It's more than a question of semantics. Following the preamble's lead, the election law, the Representation of the People Act, requires every political party to aver its commitment to socialism. And they do mean "require." SV Raju's application to form a free-market party called the Swatantrata Party was rejected by the Election Commission when he refused to include "socialism" as one of the principles of his party. He's been petitioning to overturn that decision since 1996. The Supreme Court has at least asked the government and Election Commission to reconcile this outcome with the principle of free speech.

India's Constitution as originally ratified in 1950 didn't include any mention of socialism, although the idea was proposed. The man who would become the country's first prime minister, Jawaharlal Nehru, was as socialist as they come in his economic policies. But he was also a political liberal, and he felt that forcing his personal ideology on all Indians through the preamble would be contrary to the broader spirit of the Constitution. Other founding fathers, notably B.R. Ambedkar, agreed.

Sentiments changed in the 1970s. The declaration of a State of Emergency in 1975 gave Nehru's daughter, Indira Gandhi, a convenient opportunity continue her agenda of nationalization, repaying support from the socialist parties, while expanding her own power. Amid a raft of Constitutional amendments she pushed through parliament to enhance her authority, she included one adding "socialism" to the preamble. She did this despite the Supreme Court's finding barely three years earlier that the preamble was part of the "basic structure" of the Constitution and thus not subject to amendment. The succession of socialist-leaning governments in subsequent years meant few people were interested in challenging this provision.

Instead, Indira Gandhi's successors made it worse. Her son, former Prime Minister Rajiv Gandhi, amended the Representation of the People Act in 1989 to require all political parties to include socialism in their party platforms to align with the values espoused in the Constitution's preamble. Mr. Raju's new party has run afoul of this provision.

Since the early 1990s, India has been gradually liberalizing its economy. The results are palpable -- an average 8% annual growth rate the past few years is just one. But the country's political underpinnings haven't kept pace. The Supreme Court has passed up a good opportunity to right a wrong inflicted on Indian politics 30 years ago. Parliament can still fix this mess, but no party is likely to take up the cause because in political circles capitalism and profit are, like Nehru said, "bad words." India could use the same kind of competition in the ideological sphere that's starting to work for the economy.
